This is an evergreen subject of every chat board and discussion forum.

In principle I'm against it for a number of reasons, ranging from my religious beliefs (Roman Catholic) to the fact that it is not the ultimate punishment as many think it is.

I'd go as far as life sentence for the worst crimes. However I'm pro chemical castration for child abusers and 20 years with no possibility of parole for child molestation.

I'd like to present the case of the murder of a prosecution witness...

There were 1300 outstanding arrest warrants in one city, with a police department of only 105 split among 3 shifts.. some of that 105 were secretaries, dispatchers, etc.

The POLICE could not protect the prosecution witness who was murdered to prevent testimony from being given...

Where the POLICE cannot protect, then is it the duty of the LAW to step in(Death Penalty).....

ON THE OTHER HAND

There is NO DOUBT that Kenneth Richey sitting on Ohio's Death Row for 20 years is "innocent"... or more accurately, he's served a 20-year sentence for "drunk and disorderly".

There was NO ARSON involved (the fire was accidentally set)... where there is NO ARSON then, by extension, there can be NO MURDER.

The most horifying aspect of this case IS THAT in the order for re-trial.... the DEFENSE FIRE EXPERT himself was ruled "incompetent" because he DID NOT immediately recognize that the PROSECUTION FIRE EXPERT was "incompetent"; to wit,

...the PROSECUTION FIRE EXPERT from the Ohio Crime Lab used "arson testing methodology" that had been discredited by the body that certifies forensic testimony in "arson cases".....

...any COMPETENT "arson fire expert" working for the DEFENDANT should have been able to look at the prosecution report AND IMMEDIATELY recognize that an invalidated testing protocol had been used by the Ohio Crime Lab.....

..because the DEFENSE FIRE EXPERT did not immediately recognize that the PROSECUTION FIRE EXPERT was "incompetent"... the Court ruled that the DEFENSE FIRE EXPERT himself was "incompetent" and ordered Richey to be RELEASED or re-tried.

There are a number of issues to be resolved as far as the Death Penalty is concerned....

Also, the murderers(their proteges) of 34 US Sailors aboard the USS Liberty were never even arrested MUCH LESS sentenced to death..

The US Constitution prohibits "selective prosecution" from hiding underneath the umbrella of "prosecutorial discretion"(US Constitution 14th Amendment).
